By downloading, installing, accessing, or using Speed Alert Pro ("the App," "we," "us," or "our"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the App. These terms constitute a legally binding agreement between you and Sarafand Engineering Solutions LLC, a Delaware limited liability company.
Speed Alert Pro is a supplemental driving aid that provides estimated speed limit information and audible alerts based on GPS location and third-party road data. The App is intended solely as a convenience tool and does not replace your obligation to observe and obey all posted traffic signs, signals, and applicable traffic laws.
THE SPEED LIMIT DATA AND ALERTS PROVIDED BY THE APP MAY BE INACCURATE, INCOMPLETE, OUTDATED, OR INCORRECT. THE APP RELIES ON THIRD-PARTY DATA SOURCES (INCLUDING HERE TECHNOLOGIES) AND GPS SIGNALS, WHICH ARE NOT INFALLIBLE. UNDER NO CIRCUMSTANCES SHOULD YOU RELY ON THE APP AS YOUR PRIMARY SOURCE FOR DETERMINING THE POSTED SPEED LIMIT OR SAFE DRIVING SPEED. YOU MUST ALWAYS REFER TO OFFICIAL ROADSIDE SIGNS AND MARKINGS AS THE AUTHORITATIVE SOURCE OF SPEED LIMIT INFORMATION. WE MAKE NO WARRANTY THAT THE APP WILL ALWAYS DISPLAY THE CORRECT SPEED LIMIT FOR ANY GIVEN ROAD OR LOCATION.
We do not guarantee that using the App will prevent speeding tickets, traffic citations, fines, accidents, injuries, license suspensions, or any other adverse outcomes. The App is provided as an additional awareness tool only. Safe and lawful driving is entirely your responsibility.
You agree to: (a) observe all traffic laws and posted speed limits at all times; (b) maintain full control of your vehicle; (c) never interact with the App while actively driving; (d) use the App only when it is safe and legal to do so; (e) understand that the App does not possess real-time awareness of temporary speed restrictions, construction zones, weather conditions, or emergency situations.
You expressly assume all risks associated with using the App while driving or at any other time. This includes, but is not limited to, risks arising from data inaccuracies, GPS errors, software bugs, network outages, or hardware failures.
The App offers a 7-day free trial, followed by an auto-renewable subscription billed through Apple App Store In-App Purchase. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID Account Settings after purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription. Family Sharing: subscriptions may be shared with family members through Apple Family Sharing if enabled. All prices are in USD and subject to change with notice. No refunds are handled by us; all refund requests must be directed to Apple per their App Store refund policies.
The App processes GPS location data to look up speed limits via our servers and third-party APIs (HERE Technologies). We also store anonymous usage statistics and cached speed limit data on our servers. No personally identifying information (name, email, phone) is collected. Your driving activity cannot be traced back to your real-world identity. Location data is processed in real time and retained only as necessary for caching and analytics. Cached data expires automatically after 30 days. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SARAFAND ENGINEERING SOLUTIONS LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: SPEEDING TICKETS, TRAFFIC FINES, COURT COSTS, INSURANCE PREMIUM INCREASES, LICENSE SUSPENSIONS, VEHICLE DAMAGE, PERSONAL INJURY, OR ANY OTHER DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless Sarafand Engineering Solutions LLC and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any applicable law or regulation.
We may modify these Terms at any time. Material changes will be communicated through the App or by other appropriate means. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, all provisions of these Terms which by their nature should survive termination shall survive.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively through binding arbitration in Wilmington, Delaware, except that either party may seek injunctive relief in a court of competent jurisdiction.
Speed limit data is sourced from HERE Technologies. We are not responsible for the accuracy, completeness, or timeliness of data provided by these third parties. The App also integrates third-party SDKs including RevenueCat (subscription management), Supabase (authentication and data storage), and Google Maps (map display). Use of the App is subject to their respective terms and privacy policies.
You may not use or export the App in violation of United States export laws and regulations. By using the App, you represent that you are not located in any embargoed country or on any U.S. government restricted party list.
